Terms of Service

These terms cover the Chibi Duckz Surfers app for iPhone and Android ("the app"), made by Chibi Duckz Corp ("we", "us"). We've kept them short and plain.

1. Agreement

By downloading or using the app, you agree to these terms and to our Privacy Policy. If you're under 18 (or the age of majority where you live), a parent or guardian must agree to these terms for you. Children under 13 may use the app only with a parent's permission.

2. Your license

We give you a personal, non-commercial, non-transferable license, which we can revoke, to use the app on devices you own or control. Your use is also subject to the App Store or Google Play rules for the store you got it from.

3. Playing fair

Please don't cheat, hack, mod or reverse engineer the app, exploit bugs, use bots or other automated play, or sell or trade anything from the game.

4. Virtual items and purchases

The game has coins, stars, Golden Eggs, Surf Shields, Mystery Eggs, duck tokens (Shell Tokens, Horn Tokens and Pearls), and power-up upgrades. You can also buy Golden Egg packs, Remove Ads and the Starter Pack with real money.

• License only. Virtual items and currency are part of your license to use the app. You don't own them, they have no cash value, and they can't be exchanged for money or moved to another person or app.
• Your progress lives on your device. Coins, stars, levels and other items are deleted if you delete the app or its data. On iPhone, Golden Egg totals are also saved in your own iCloud account. On Android, your progress may come back from your Google account backup if backup is turned on. We can't recover anything for you.
• Game balance can change. We may change prices in coins or Golden Eggs, rewards, odds and how items work.
• Purchases are final, except where the law or Apple's or Google's refund policies say otherwise. To ask for a refund, use reportaproblem.apple.com on iPhone or your Google Play order history on Android.
• Restore Purchases. Remove Ads and the Starter Pack can be restored from the Shop on the same Apple Account or Google Account. Golden Egg packs are used up as you spend them and can't be restored.

5. Ads

The app shows ads from Google AdMob. Reward ads, for a revive, double coins or a free Mystery Egg, only play when you choose to watch them. We don't control the content of ads or the sites they lead to, and we aren't responsible for them.

6. Third-party services

The app uses Apple's App Store and iCloud on iPhone, Google Play on Android, and Google AdMob. Your use of those services is covered by their own terms.

7. Ownership

Chibi Duckz Corp owns the app and everything in it, including the Chibi Duck characters, Danger Crock, the art, music, sounds, names and trademarks.

8. Changes and availability

We may update, change or stop offering the app or any feature. We may also update these terms. If we do, we'll post the new version here with a new effective date, and using the app after that means you accept it.

9. Ending these terms

You can stop at any time by deleting the app. We may suspend or end your access if you break these terms.

10. Disclaimers

To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, and we don't promise it will always work without interruptions or bugs.

11. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages. Our total liability for any claim is limited to the amount you paid for the app or items in it in the 12 months before the claim, or US$50, whichever is more. Nothing in these terms limits rights you have under consumer law that can't be waived, for example in the EU or UK.

12. Apple and Google

These terms are between you and Chibi Duckz Corp, not Apple or Google, and we alone are responsible for the app.

• Apple and Google have no obligation to provide maintenance or support for the app.
• If the app fails to meet a warranty that applies, you may notify Apple or Google, and they may refund the purchase price. To the extent the law allows, they have no other warranty obligation for the app.
• We, not Apple or Google, are responsible for handling any claims about the app, including product liability claims, claims that the app doesn't meet a legal or regulatory requirement, consumer protection claims, and claims that the app infringes someone's intellectual property.
• You confirm that you aren't located in a country under a US government embargo or designated as "terrorist supporting", and that you aren't on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. If you're a consumer, you keep the protections of the law where you live.
